Jefferson County's Prosecuting Attorney is Paul Butikofer. The Prosecuting Attorney prosecutes all actions, applications, and motions in the District Court and Magistrate's division in which the People, the State or the County is a party. Along with the Sheriff, the Prosecutor functions as the chief law enforcement officer in Jefferson County. The Prosecuting Attorney is also the legal counsel for the Board of County Commissioners, as well as other elected officials of the county.
Prosecuting Attorney as Constitutional Officer:
Article V, Section 18 of the Idaho Constitution states that a prosecuting attorney shall be elected for each organized county in the state, by the qualified electors of such county, and shall hold office for the term of two years, and commencing with the general election in 1984 shall hold office for the term of four years, and shall perform such duties as may be prescribed by law; he shall be a practicing attorney at law, and a resident and elector of the county for which he is elected. He shall receive such compensation for services as may be fixed by law.

The salary and expense budgets of the prosecuting attorney's office are set by the county commissioners. Article XVIII, Section 7 of the Idaho Constitution states that the prosecuting attorney's salary shall receive a fixed annual salary to be set by the county commissioners.
